ORDINANCE NO. 1998-10
DOG AT LARGE

The purpose of this Amended Ordinance is to preserve and secure the health, safety and general welfare of the public and for the protection and disposition of dogs subject to unhealthful or dangerous conditions or circumstances.

The Santa Cruz County Board of Supervisors of the County of Santa Cruz County does therefore, ordain as follows:

SECTION 1 DEFINITIONS

1.1 At large means being neither confined by an enclosure nor physically restrained by a leash.

1.2 Owner means any person owning, keeping, possessing, harboring, or maintaining a dog within Santa Cruz County.

SECTION 2 DOGS AT LARGE PROHIBITED, EXCEPTIONS

2.1 The owner or person having control of a dog shall at all times keep such dog from being at large upon the public streets, sidewalks, alleys or other public property, unless such dog is restrained by leash, chain rope or cord of not more than six feet in length and of sufficient strength to control the action of said dog.

2.2 It shall be unlawful for any dog owned, possessed, harbored, kept or maintained to be at large upon the private property of any person including that of the owner. Confinement shall be accomplished by means of a fence or similar enclosure of sufficient strength and height to prevent the dog from escaping therefrom, or inside a house or other building, or by being secured to a leash, rope, or chain of not less than ten (10) feet in length which is fastened or picketed in such a manner so as not to injure the dog and so as to keep the dog exclusively on the premises.

2.3 EXCEPTIONS 

A. Dogs may be at large:

  1. while participating in field trials, recognized kennel club events, obedience classes;
  2. while assisting their owner or trainer in legal hunting or controlling livestock;
  1. while assisting a peace officer engaged in law enforcement duties;
  1. guide or service dogs while assisting the legally blind, visually impaired, the deaf and auditorily impaired or the physically handicapped
  2.   Upon the premises of the owner of the dog if said property consists of 36 or more contiguous acres or if less than 36 contiguous acres if the dog is accompanied by and under the control of the owner. 

Provided however that neither a female dog during her mating nor breeding season nor a vicious dog (as defined by A.R.S. 11-10001 (16), shall be permitted at large.  No dog shall be permitted at large in a rabies quarantine area.

SECTION 3 DOG WASTE REMOVAL; EXCEPTIONS, PENALTY

3.1 It shall be unlawful for the owner of any dog to fail to immediately remove and dispose, in a sanitary manner, of any solid waste deposited by such dog on public property or deposited on private property without consent of the person in control of the property.

3.2 EXCEPTIONS

This section shall not apply to:

  1. the legally blind, the visually impaired or persons with physical mobility disabilities;
  2. peace officers engaged in law enforcement duties accompanied by police dogs.

3.3 Violations of Section 3.1 shall be a petty offense

SECTION 4 IMPOUNDMENT

4.1 Santa Cruz County Animal Control may impound any dog at large contrary to the provisions of this ordinance.

4.2 The owner of such dog or the authorized representative of the owner shall be charged with the cost of pick-up, impoundment, and any other costs related to impoundment of the dog or bringing the dog in compliance with Arizona Revised Statutes, 11-1001-11-1020 pursuant to which a schedule of fees has been duly authorized.

4.3 The owner of any dog or the authorized representative of the owner may reclaim said dog in accordance with and after complying with the provisions of Arizona Revised Statutes, 11-1001 – 11-1020.

SECTION 5  PENALTY

Any person found guilty of violating any Section of this ordinance shall be guilty of a Class 2 Misdemeanor, if not otherwise specified. 

SECTION 6 SEVERABILITY

If any provision of this ordinance is held invalid, its invalidity shall not affect any other provision of this ordinance that can be given effect without the invalid provision, and for this purpose the provision of this ordinance are hereby declared severable.

SECTION 7 REPEALER

All ordinances and parts of ordinances in conflict with the provisions of this ordinance are repealed.
